Federal law requires that mortgage companies comply with the Red Flags Rule by December 31, 2010.  What does that mean for you?

 

The Red Flags Rule was designed to mitigate potential identity theft.  The rule requires certain companies to develop and implement a written identity theft program to detect the warning signs - or "red flags" - of identity theft in their organizations.  If your company arranges for loans or makes credit decisions, you fall under the purview of the rule.

 

What do you have to do? Well, the rule requires you to develop written policies and procedures (i.e. your "program") to:

 

1. Identify the "red flags" of identity theft that you may run across in the day-to-day operation of your business (e.g. falsified W-2s)

 

2. Create procedures to detect the red flags you've identified

 

3. Have a plan of action to take when you spot a red flag

 

4. Continually evaluate potential identity theft risks

 

Additionally, the rule requires you to designate a senior employee to administer your program and to provide appropriate training to your employees regarding your program.  You must also conduct background checks of future employees.
